Bihar Records India’s First Conviction Under BNS, Juveniles Get Life Term for Killing Man, His Daughters

Saran district in Bihar secured the first conviction under Bharat Nyaya Sanhita in India in 50 days after a triple murder case, marking a historic day for Bihar Police

Bihar has become the first state in the country to secure conviction under the new criminal law of India, Bharat Nyaya Sanhita (BNS). After the FIR was registered and the investigation was carried out by the Saran Police in Bihar under the new BNS law, the two juvenile accused in a triple murder case have been sentenced to life.

The court has imposed life imprisonment and a fine of Rs 25,000 against the two juvenile culprits. This case was related to a love affair, in which two boys killed two minor girls and their father with a sharp weapon. The criminals brutally murdered the father and his two minor daughters sleeping on the roof of the house at night. After the speedy trial, on Thursday, on the 50th day since the murders, both the juvenile accused have been sentenced to life imprisonment.

After the implementation of the Indian judicial code on July 1, for the first time in the country, someone has been sentenced under this new law.

“Today is a historic day for both Bihar and Bihar Police. Saran has become the first district in the country and Bihar the first state to secure conviction in cases registered under BNS. On July 17, at 2 am, we received information from Dial 112 number that three members of a family have been murdered with a sharp weapon. The deceased included the father and two minor daughters. Within an hour of the incident, we arrested both the accused,” Saran Superintendent of Police Dr. Kumar Ashish said speaking to News18.

Speaking in detail about the case, Ashish said, “We started the investigation by registering a case under Section 103 (1), 109 (1), 329- 4/3 (5) in Rasulpur police station. We took the help of forensic experts as well. Following the instructions of India’s three new laws BNS, BNSSS and BNSA, a speedy charge sheet was filed on July 31, that is, within 14 days. After this, we requested the Honourable Court to conduct a speedy trial. The court took cognizance and started the speedy trial from August 13. On the 22nd day, on September 3, both were convicted and today on the 50th day of the incident, both have been sentenced. Within 48 days, the court had found both the accused Sudhanshu Kumar alias Roshan and Ankit Kumar guilty.”

Further, speaking about the investigation, the SP said, “From the beginning, we had decided that we will solve this case quickly through a speedy trial. Our entire team was engaged in this case day and night, because the case was from the same village and that too involving a love affair. So I felt that the matter might become bigger. The boy was angry because the girl had stopped talking to him. After this, the boys bought knives from the nearby market and climbed the roof with the help of the wall and killed both the girls and their father. We gave the evidence of DNA, FSL and serological reports to the court, which the court found correct and pronounced the verdict today.”

“Bihar’s new DGP Alok Raj has congratulated the entire team. We will meet him very soon,” the SP added.

Dr. Kumar Ashish is a 2012 batch IPS officer of the Bihar cadre. Ashish holds a doctorate degree from JNU. He is fond of studying as well as teaching. While he was posted at Muzaffarpur, he started the Railway Police Pathshaala for the abandoned children roaming around the station. In this school, orphan children are given free education. The Railway Police started this initiative on August 15 last year.

Before taking over as Saran SP, Dr Ashish had served as the Railway Superintendent of Police of Muzaffarpur. He served as a Trainee SP in Motihari, and then as Madhepura SP in 2014 and then the SP of Nalanda.
