‘Assure Doctors We Are Concerned’: Supreme Court On Ongoing Protests Over Kolkata Doctor Rape-Murder | Top Quotes

The bench was told by the counsel for resident doctors at AIIMS Nagpur that they are being victimised for protests over the Kolkata rape-murder case.

The Supreme Court on Thursday urged the protesting doctors to return to their work while assuring that there would be no victimisation and, no adverse action would be taken once they rejoin.

A bench comprising Chief Justice DY Chandrachud and justices JB Pardiwala and Manoj Misra resumed hearing in a case related to the rape and murder of a trainee doctor at the RG Kar Medical College and Hospital in Kolkata.

The bench was told by the counsel for resident doctors at AIIMS Nagpur that they are being victimised for protests over the Kolkata rape-murder case.

The court also observed that the CRPC procedures were not followed by Kolkata police during the investigation.

While the case was being heard, CBI counsel told the court that the “evidence was altered” by the time they entered the probe on Day 5.

  • “Once they get back to duty, we will prevail upon authorities to not take adverse action. How will public health infrastructure run if the doctors do not work,” the bench, said.
  • CJI Chandrachud said, “I have slept on the floor of a public hospital when someone in the family was unwell. We know that doctors work over 36 hours.” SG Tushar Mehta said, “All doctors who are part of the committee have gone through all of it themselves.”
  • The concerns of the doctors have to be addressed by the committee…there’s one thing about the committee that it has lot of female members on the committee so that voices can be heard.
  • “They (patients) take appointments two years back, and suddenly told that they will not be attended. Let all doctors resume work. Please rest assured that once the doctors resume duty, then we will prevail upon the authorities to not take any adverse action. How does public health infrastructure run if doctors will not resume work?”
  • We will observe that the committee hears all the members and the RDAs. Please ensure the doctors that we will pass orders that the committee will hear them.
  • Most shocking fact is that FIR was registered at 11.45 pm after cremation of deceased, SG Tushar Mehta told the apex court.
  • “I have not come across a case like this in my last 30 years, Bengal not following criminal procedure code.”

In an earlier hearing held on Tuesday, the CJI Chandrachud-led Bench urged doctors and medical professionals across the country to resume work at the earliest.

It ordered the Central Bureau of Investigation (CBI) to file a status report detailing the status of the investigation within two days as well as the state government to file a status report in relation to the incident of vandalisation inside the hospital premises.

As doctors’ protests continued in different states on Wednesday, OPD services remained hit. The IT Ministry had asked social media platforms to immediately comply with the Supreme Court order on the removal of the name, photos, and videos of the trainee doctor who was raped and murdered in Kolkata’s RG Kar Medical College and Hospital.
